Terms & Conditionsfor the MIXLDN 2017 Beefeater Global Bartender Competition

The following terms and conditions (“Terms and Conditions”) govern your entry into the MIXLDN 2017 Beefeater Bartender Competition (“Competition”).

By entering the Competition, you accept these Terms and Conditions and agree to abide by them.

Overview

The Competition is a multi-jurisdictional competition being run by Chivas Brothers Limited (the “Promoter”) and administered by the local contracting party as detailed herein to find the best bartender. There are two phases:

  • Phase one, called the “National Competition”, as operated by the company in your country as listed at the end of these terms (“Beefeater” or “we”), who will find the winning bartender in each participating country from initial website recipe entries and then a further judging of the top ranked country entries;

  • Phase two, called the “Global Competition”, involves all of the participating countries’ winners competing in a competition in London from 5 -9 February 2018. During the Global Competition, all country winner finalists will be further judged across common challenges and the best eight will be ranked from the group to go on to compete in a live grand final event in front of industry guests and press.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions.

The National Competition in your country is governed by the National Terms and Conditions, as detailed herein. The Global Competition is governed by the Global Terms and Conditions, as detailed herein. By entering the National Competition you are agreeing to the National Terms and Conditions and in the event you are the winner of the National Competition, you hereby also agree to the Global Terms and Conditions. Please retain a copy for your information.

National Terms and Conditions

Eligibility

  1. The Competition is open to the residents of Austria, Argentina, Belgium, Bulgaria, Brazil, Canada (excluding residents of the Province of Quebec), China, Cuba, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hong Kong, Italy, Lithuania, Japan, Mexico, New Zealand, Norway, Poland, Portugal, Peru, Serbia, Montenegro, Slovakia, Sweden, United Kingdom and United States of America. The Competition is not open in any country where prohibited or restricted by applicable law. If your country of residence is not available on the entry form on www.beefeatermixldn.com then you are not eligible to enter.

  2. To enter and be eligible to win the National Competition, you must be at least 21 years old, of legal drinking age in your country and old enough to be legally employed as well as enter and participate in prize competitions in your country.

  3. Officers, directors and employees and their immediate families of the Promoter, Beefeater, and their parent, subsidiaries, and affiliates or anyone professionally associated with this Competition are not eligible to enter.

  4. No payment or purchase is necessary to enter or win the Competition.

  5. Only one entry may be submitted per person.

  6. By submitting your details online you are consenting to the Promoter and Beefeater using those details to contact you with future communications regarding the Competition (including future years’ competitions) and, where you consent to receive this, other communications relating to the Promoter’s products and competitions that we think will be of interest to you. You will always be given the opportunity to opt out of communications except for administrative communications relating to the Competition.

  7. When you submit your entry you will be asked to provide details of your place of work for inclusion on your profile page on the Competition website. By providing those details you are confirming that your employer/place of work has approved is inclusion on the Competition website.

  8. If you win the National Competition, you are responsible for assessing the tax implications of any prize and paying any tax due or owing on the prize received.

  9. The launch date of the National Competition is 1 July 2017 and entries will be accepted online on the official website (www.beefeatermixldn.com) from this date. The closing date of the National Competition for your country is specified on the official entry form on the website (“National Competition Closing Date”). No further applications will be accepted after the National Competition Closing Date. Entries will only be accepted on the official website utilising the official entry form.

  10. National Competition finalists and winners may (at the option of the Promoter) also be included in local, global above the line advertising, PR and promotional material and product packaging or promotional material (“Advertising”) for no consideration at the Promoter’s and/or Beefeater’s choice. By entering the Competition you agree to being included in Advertising by the Promoter and Beefeater.

How to enter

  1. To enter the National Competition, you need create an original cocktail using the city in which you live and work as your inspiration. You should design your cocktail to celebrate the urban diversity of the city you live and work in. We want you to look at any aspects of your city's culture, art, music, food and people to get your inspiration. Then take this inspiration and mix it with the spirit of London, Beefeater Gin.

  2. Your recipe must be your original creation. Any plagiarised entries or help from third parties will result in your disqualification.

  3. Recipes can be a long or short cocktail. Shots are not permitted.

  4. All recipes must contain at least 30ml (1 oz) of Beefeater Dry or Beefeater 24. All recipes ingredients must be expressed in ounces, millilitres, dashes, shares, and drops. For example, “juice of half a lemon” is not acceptable.

  5. Your recipe must include a clear, step by step description of how to prepare and serve the cocktail.

  6. Drinks may be served hot or cold, straight-up or over ice.

  7. Your recipe may specify a garnish. Garnishes must be edible and may be mounted on sticks, skewers, straws, forks or other hygienic accessories. Use of edible fruits, flowers, petals, herbs, leaves and spices (which can include sprigs, peels, barks, fruit shells etc.) is permitted.

  8. You must be capable of preparing three servings of your cocktail to the recipe provided within a 10 minute window. If used, garnishes may be prepared in advance but must be able to be incorporated into the cocktail within the 10 minute window.

  9. You must provide a suitable name for your cocktail, which you acknowledge shall not breach the intellectual property rights of any third party; the Promoter reserves the right to disqualify or request an amendment to any entry to the extent that it has any concerns in this regard. Names including rude, lurid, or sexual words, or words associated with drugs, children or motor vehicles will not be accepted and may result in disqualification at the Judges’ discretion.

  10. You must submit your recipe including the preparation and serving details together with a photograph of yourself, and photograph of the finished cocktail as you present it, and a cocktail name on the official entry form on the website at www.beefeatermixldn.com. There is a 100MB maximum for uploads and accepted file types are png, jpg, jpeg.

  11. You must enter the Competition in your own name. If there is any dispute as to the identity of the person who made the entry, the person named in the entry will be deemed the entrant. If you are selected as a potential winner you will be required to provide proof of age and identity and enter into an agreement with the Promoter to confirm (among other things) your details and eligibility for the Competition. Group entry is not permitted.

  12. By entering you agree that we can create an individual public profile including your recipe, drink name, drink photograph, your photograph and details of your place of work on the beafeatermixldn.com website.

  13. All entries will be subject to a validation process to ensure the above requirements are met. The Promoter may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the prize may be withheld until and unless the Promoter (in its sole discretion) is satisfied with the verification. The Promoter’s decision is final.

  14. Note: The Promoter shall own the full intellectual property of whatsoever nature in your entry (including without limitation the name). By entering the Competition, you are assigning (transferring ownership of) all intellectual property rights in your recipe and cocktail name to the Promoter. By entering the Competition you grant to the Promoter and its agents the right to adapt, edit, publish and use your entry and your likeness in any way, including by featuring in whole or in part, in particular on the Competition website, in commerce and in any products, packaging or promotional materials and in any and all media worldwide now known or hereinafter developed on a worldwide basis and without further consideration or notice to you. Providing any entry further constitutes your transfer to the Promoter of any and all rights, title, and interest in and to the entry and including, without limitation, all intellectual property rights in the entry.

  15. By submitting an entry, you agree, warrant and represent that your entry is made without restriction, and will not place Promoter under any obligation or liability of whatever sort and howsoever caused and that you will fully indemnify the Promoter for any breach of the Terms and Conditions howsoever arising.

  16. The Promoter is free to disclose the entry and any ideas contained in the entry on a non-confidential basis to anyone or otherwise use the ideas without any compensation to you. You acknowledge that by acceptance of your entry, the Promoter does not waive any rights to use similar or related ideas previously known to Promoter, or developed by its employees, or obtained from sources other than you.

Judging Process

  1. All the valid entries received in the entry period will be assessed by a panel of judges (“Judges”), which panel shall contain at least one Judge not employed as an employee by Beefeater or the Promoter. Beefeater shall appoint the panel of Judges and reserves the right to replace or appoint new Judges before or during the National Competition. The selected Judges shall be impartial and asked to declare any interest they may have in the Competition or any competitor.

  2. The Promoter reserves the right to exercise a full and final decision on any matter relating to the judging of the National Competition.

  3. The Judges shall judge the entries according to the following broad criteria:

    • Appearance
      Does the cocktail look appealing in the photograph?
      5%

    • Balance
      Judging from the recipe is there one flavour/element of the cocktail that dominates or is there a good balance between the ingredients?
      30%

    • Beefeater Characteristics
      Is Beefeater the star of the show? Judging from the recipe, has the bartender understood the flavour profiles of either Beefeater Dry or Beefeater 24 and chosen ingredients that complement the chosen gin?
      15%

    • Originality
      Has there been interesting/innovative use of ingredients, methodology, equipment, presentation etc.?
      20%

    • Inspiration & Execution
      Can we see clear inspiration in the recipe of the creative and cultural side of the city in which the bartender works?
      30%

  4. The Judges will select at least 8 and up to 12 entries of the best ranked entries as finalists and these finalists will be notified by telephone and/or email using the information provided on their official entry form.

  5. These finalists will be contacted by no later than ten days before the beginning of the National Competition final event (“National Finals”), as detailed in paragraph 32 below.

  6. The finalists will be invited to attend the National Finals, which will take place between 1 September 2017 and 20 December 2017. Precise details of the National Finals event including location will be notified to the finalists by Beefeater at the time of final selection.

  7. If a finalist does not respond to notification of their selection as a finalist within the time period specified by the Promoter and/or Beefeater or cannot be verified within the time required by the Promoter or Beefeater, or if a finalist is otherwise unable to accept their status as a finalist, cannot attend the National Finals or is otherwise ineligible, their selection as finalist will be forfeited and an alternative finalist may be selected from reserves judged at the same time at the Promoter's sole discretion.

National Finals

  1. If you are a finalist, at the final you will be required to prepare at least three identical cocktails in accordance with the recipe you entered for judging and photography purposes.

  2. The cocktails must be prepared by you within a maximum of 10 minutes. Additionally you will have 10 minutes preparation time.

  3. If the Judges determine that your cocktail preparation method, ingredients (including garnishes), props, equipment or glassware/containers are unsafe or unhygienic you may be disqualified.

  4. The equipment and facilities described below will be provided at the final:

    1. Beefeater Dry and Beefeater 24 gin;

    2. frozen cubed ice, block ice for chipping/carving and an ice-crusher. Please ensure your ice requirements are clearly specified in your recipe;

    3. basic bar equipment;

    4. basic glassware can be provided on request. You are recommended to bring your own glassware/containers sufficient for three cocktails;

  5. You must bring your own spirits and mixers, any other equipment, special ingredients, garnishes or props with you to the final. Beefeater and the Promoter cannot guarantee and accept no responsibility or liability for the safety and security of your items.

  6. Your cocktail can be presented in any shape of glass, cup or other hygienic and safe container.

  7. With the exception of the Beefeater Dry and Beefeater 24 logos, no other equipment or glassware you bring should have logos visibly displayed (except the normal discrete trade mark of the glass or equipment manufacturer).

  8. Eligible entries at the final will be judged according to the following criteria:

    1. The Drink (90 points):

      • Appearance. Does the cocktail look appealing?

      • Aroma. Is the aroma inviting? Have aromatics been considered?

      • Balance. Does one flavour/element of the cocktail dominate or is there a good balance between the ingredients?

      • Beefeater Characteristics. Is Beefeater the star of the show? Judging from the recipe, has the bartender understood the flavour profiles of either Beefeater Dry or Beefeater 24 and chosen ingredients that complement the chosen gin?

      • Originality. Has there been interesting/innovative use of ingredients, methodology, equipment, presentation etc.?

    2. The Concept (50 points):

      • Inspiration. Can we see clear inspiration in the recipe of the creative and cultural side of the city in which the bartender works?

      • Evolution. Can we clearly see what inspired the bartender in his/her finished cocktail?

    3. Bartender Judging (10 points):
      In this part of the National Finals, each finalist will participate in the judging of the other finalists’ entries as follows:

      • One of the finalist’s cocktails will be handed to the other finalists who will judge the cocktail based on appearance and taste.

      • This cocktail will be marked out of 10 points by each finalist (excluding his/her own cocktail and the cocktail of the immediately before him/her as this will be during his/her allotted preparation time.

  9. You must behave in a safe manner throughout the final and any action considered by Beefeater or the Judges to endanger fellow competitors, Judges or spectators may result in disqualification.

Announcing the National Competition winners

  1. If you are a finalist, at the final you will be required to prepare at least three identical cocktails in accordance with the recipe you entered for judging and photography purposes.

  2. The cocktails must be prepared by you within a maximum of 10 minutes. Additionally you will have 10 minutes preparation time.

  3. If the Judges determine that your cocktail preparation method, ingredients (including garnishes), props, equipment or glassware/containers are unsafe or unhygienic you may be disqualified.

The National Competition Prize

  1. The National Competition Prize Winner will win the National Competition Prize, which shall be:

    1. Return economy flights to London to participate in the global final in London in February 2018;

    2. Transfers to and from the relevant airport in London;

    3. Three (3) nights’ accommodation at a London hotel of the Promoter’s choice;

    4. Breakfast, lunch and dinner and cocktails at selected venues;

    5. Transportation to and from Competition events.

  2. The National Competition Prize Winner must pay the cost of transport to and from his/her originating airport, travel insurance, any other travel related costs not specified above (including without limitation excess baggage charges, obtaining passports and visas to enter the UK), and for any other costs or expenses not specified above. Note, any room service, mini-bar or other charges at the hotels will be at the expense of the National Competition Prize Winner.

  3. Travel dates are not changeable and non-transferrable. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades.

  4. The approximate retail value of the National Competition Prize is one thousand five hundred pounds (£1500). The actual retail value of the National Competition Prize depends on the home country of the winner, airfares, accommodation and other costs at the time of booking, but if actual retail value is less than stated approximate retail value, the difference will not be awarded.

  5. All reservations and travel arrangements shall be with suppliers selected by the Promoter in its sole and absolute discretion. All arrangements will be made through a travel agent selected by the Promoter and are subject to availability. The National Competition Prize may not be combined with any other offer and travel may not qualify for frequent flyer miles. The National Competition Prize is not assignable, substitutable or transferable by the winner.

  6. As stated above, the finalist will be required to submit to a confidential background check to help ensure that the use of any such person in advertising or publicity for the promotional activity will not bring Promoter into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Competition or the security and integrity of the Competition, the Promoter or Beefeater, as assessed by the Promoter in its sole discretion. The Promoter reserves the right in its sole discretion to disqualify a finalist on the basis of the findings resulting from such background checks.

  7. A cash alternative is not available for the National Competition Prize or any part thereof. The Promoter reserves the right to substitute a prize of equal or greater value due to unavailability or otherwise in its absolute discretion.

  8. The Promoter shall make available on the National Competition website the name and county/area of residence of all National Competition Prize Winners for a period of up to three months after the relevant National Competition Closing Date.

Advertising

  1. The Promoter and/or Beefeater may choose to use National Competition finalists and the National Competition Prize Winner in pre and / or post-event Advertising. By entering the Competition you agree to being included in Advertising.

  2. The Promoter shall own all right, title and interest in and to any Advertising. In respect of your image rights and any materials (including, without limitation, the name and entry photograph of your cocktail), you grant Beefeater and the Promoter the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such image rights and material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You also irrevocably waive any “moral rights” you have in the Advertising and materials in favour of Beefeater and the Promoter.

General and Data Protection

  1. No third party entries, bulk or multiple entries, entries submitted by agents/syndicates or any activity trying to undermine the Competition will be accepted.

  2. No responsibility can be taken for entries/claims which are misdirected, lost, delayed, damaged or corrupted during delivery to or from the Promoter due to any computer malfunction, virus, bug, delay, erroneous or other reason whatsoever. The Promoter is not responsible for any incorrect or inaccurate information supplied to the Promoter by the entrant in the application.

  3. Any personal data relating to entrants will be used solely in accordance with current data protection legislation and will not be disclosed to a third party (other than the Promoter’s and/or Beefeater’s agencies or suppliers for the purpose of servicing/implementing the promotion and prizes) without your prior consent. See Beefeater’s privacy policy for more details as to how any personal data provided to Beefeater or the Promoter may be processed. By entering the Competition, you consent to your personal data being processed in accordance with these Terms and Conditions and the Privacy Policy referred to herein.

Compliance with Pernod-Ricard code for commercial communications

  1. Beefeater and the Promoter are a part of the Pernod-Ricard group, and they promote a moderate approach to the consumption of alcohol. You agree that if you are selected to participate in the National Finals, including travelling to and from the National Finals, or at any time you are likely to be perceived as an ambassador of the Pernod-Ricard group’s business and brands, you agree to comply with the Pernod Ricard Code for Commercial Communications (viewable at www.pernod-ricard.com) including without limitation by not:

    1. participating or encouraging the underage purchase or drinking of alcoholic beverages;

    2. participating or encouraging irresponsible or immoderate drinking;

    3. participating or encouraging over-consumption;

    4. encourages the drinking of alcohol during pregnancy;

    5. condemning or criticising in any way anyone who chooses not to consume alcohol;

    6. participating in any activity which portrays irresponsible drinking in a positive light or participating or encouraging drinking with driving, operating any kind of machinery or engaging in any kind of dangerous activity;

    7. participating in any activity which suggests alcoholic beverages consumption contributes to any kind of success (for instance in the field of personal relationships, social success, popularity, work, sports or which suggests that it can enhance mental or physical performance);

    8. participating in any activity which glorifies the alcohol strength, relatively high alcohol content or intoxicating effect of a cocktail;

    9. participating in any activity which relates drinking alcohol to any kind of illegal, antisocial, dangerous, aggressive or violent behaviour;

    10. doing or failing to do anything else which may bring Pernod-Ricard’s business or brands into disrepute.

    If at any time you are considered to be practising or promoting any form of irresponsible drinking or any behaviour that will or may bring Promoter into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Competition or the security and integrity of the Competition, as assessed by the Promoter in its sole discretion, you will be disqualified from the Competition.

  2. The National Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed and construed in accordance with the laws of the country of the National Competition. The courts of England and Wales shall have the non-exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the terms, or their subject matter or formation (including non-contractual disputes or claims).

Global terms and conditions

  1. By entering the National Competition you have agreed to be bound by the Global Terms and Conditions in the event you are the winner of your National Competition.

  2. Definitions used in the National Terms and Conditions shall apply in the Global Terms and Conditions (and vice versa), unless otherwise defined in the Global Terms or the context otherwise requires.

Eligibility

  1. If you are the winner of your National Competition you automatically qualify to attend the Global Competition as a Global Competition finalist.

  2. You will be sent an information pack by email in good time before the Global Competition event which is scheduled to take place in London in February 2018 (the “Grand Final”). The pack will include full details of the Grand Final (including the exact date and location), travel dates, accommodation and other relevant information.

  3. In order to take part in the Global Competition you must be available to travel within the travel dates specified in the information pack. If you are not able to travel for any reason you must notify the Promoter using the contact details provided in the winners’ pack as soon as possible. In those circumstances you will forfeit your right to participate in the Grand Final and an alternative National Competition Prize Winner will be chosen.

Entries for the global competition

  1. You are entitled to request to enhance your cocktail entry that you submitted for the National Competition for the purposes of the Grand Final up until 15 December 2017. Changes must be communicated in writing to your National Competition representative who will then notify the Promoter. Enhancements must be approved in writing by the Promoter in order for the National Competition Winner to utilise them in their enhanced form at the Grand Final.

  2. All revised entries for the Grand Final must comply with the same entry requirements as the National Competition, which are set out below:

    1. You need to craft a cocktail that infuses Beefeater gin with the spirit of athe city you live and work in.

    2. Recipes can be a long or short cocktail. Shots are not permitted.

    3. All recipes must contain at least 30ml (1 oz) of Beefeater Dry or Beefeater 24. All recipes ingredients must be expressed in ounces, millilitres, dashes and drops. For example, “juice of half a lemon” is not acceptable.

    4. Your recipe must include a clear, step by step description of how to prepare and serve the cocktail.

    5. Drinks may be served hot or cold, straight-up or over ice.

  3. Note: The Promoter shall own the full intellectual property of whatsoever nature in your revised entry (including without limitation the name). By entering the Competition, you are assigning (transferring ownership of) all intellectual property rights in your recipe and cocktail name to the Promoter. You grant to the Promoter and its agents the right to adapt, edit, publish and use your entry and your likeness in any way, including by featuring in whole or in part, in particular on the Competition website, in commerce and in any products, packaging or promotional materials and in any and all media worldwide now known or hereinafter developed on a worldwide basis and without further consideration or notice to you. Providing any entry further constitutes your transfer to the Promoter of any and all rights, title, and interest in and to the entry and including, without limitation, all intellectual property rights in the entry.

Equipment at the Grand Final

  1. The equipment and facilities described below will be provided at the Grand Final.

    1. Beefeater Dry and Beefeater 24 gin;

    2. rozen cubed ice, block ice for chipping/carving and an ice-crusher. Please ensure your ice requirements are clearly specified in your recipe;

    3. basic bar equipment;

    4. basic glassware can be provided on request. You are recommended to bring your own glassware/containers sufficient for three cocktails;

    5. basic bar spirits, mixers, garnishes and ingredients.

  2. You must bring your own special equipment, special ingredients, garnishes or props with you to the Grand Final. Beefeater and the Promoter cannot guarantee and accept no responsibility or liability for the safety and security of your items.

  3. Your cocktail can be presented in any shape of glass, cup or other hygienic and safe container.

  4. If the Judges determine that your cocktail preparation method, ingredients (including garnishes), props, equipment or glassware/containers are unsafe or unhygienic you will be disqualified.

  5. With the exception of the Beefeater Dry and Beefeater 24 logos, no other equipment or glassware you bring should have logos visibly displayed (except the normal discrete trade mark of the glass or equipment manufacturer).

Judging at the Grand Final

  1. The Promoter will select a panel of judges (“Grand Final Judges”) of a number determined by the Promoter, which panel shall judge the Grand Final and shall contain at least one Grand Final Judge not employed as an employee by Beefeater or the Promoter and Desmond Payne, Beefeater Master Distiller. The Promoter reserves the right to replace or appoint new Judges before or during the Grand Final Competition. The selected Grand Final Judges shall be impartial and asked to declare any interest they may have in the Competition or any competitor.

  2. The Promoter reserves the right to exercise a full and final decision on any matter relating to the judging of the Grand Final.

  3. The Grand Final will take place over 2-3 days. The Grand Final will include a number of rounds of challenges, details of which are confidential until the commencement of the Grand Final.

  4. During the first day of the Grand Final, the Grand Final Judges will attribute scores and therefore rankings to the finalists for each of the challenges. At the end of the day, the best eight finalists will proceed to the live stage of the Grand Final.

  5. Specifics of the judging criteria will be explained at the Grand Final but overall the following criteria will be integral to the scoring of the cocktails by the Grand Final Judges throughout the Grand Final:

    1. The Drink:

      • Appearance. Does the cocktail look appealing?

      • Aroma. Is the aroma inviting? Have aromatics been considered?

      • Balance. Does one flavour/element of the cocktail dominate or is there a good balance between the ingredients?

      • Beefeater Characteristics. Has the bartender understood the flavour profiles of either Beefeater or Beefeater 24 and chosen ingredients that complement the chosen gin? Does Beefeater shine through?

      • Originality. Has there been interesting/innovative use of ingredients, methodology, equipment, presentation etc.?

    2. The Concept:

      • Inspiration. Can we see the influence of your city in the cocktail?

      • Evolution. Can we clearly see what inspired the bartender in his/her finished cocktail?

      • Understanding Beefeater. Has the bartender shown an understanding of the brand, its history, and its role in classic and modern cocktails?

  6. Following selection of the eight finalists for the Grand Final, there will be a live stage of the Grand Final. At this stage, the eight finalists will each be given a maximum of 10 minutes (with 10 minutes preparation time) to prepare at least three identical cocktails in accordance with their recipe.

  7. The cocktail will also be judged by industry guests (“Industry Judging”) who will vote with tokens (one per guest) for their favourite cocktail.

  8. The scores from the Industry Judging will be added to the Grand Final Judges’ scores. The winner (“Grand Prize Winner”) will be the person with the highest score, as determined and calculated by the Grand Final Judges. In the event of a tie, Desmond Payne the Master Distiller shall have the deciding vote.

The Grand Prize

  1. The Grand Prize Winner will win the grand prize (“Grand Prize”) which shall comprise:

    1. a three day trip to London to attend a day’s individual training at the Beefeater Distillery in London with Desmond Payne, the Beefeater Master Distiller;

    2. during this trip, they will have the opportunity to craft their own gin under the supervision of Desmond Payne, the Beefeater Master Distiller, at the Beefeater Distillery in a limited quantity determined by the Promoter (“The Limited Edition”); and

    3. have the opportunity, subject to written agreement with Beefeater and the Promoter on terms and conditions specified by Beefeater and the Promoter, to represent the brand in Beefeater events in his or her geographic region for no further consideration.

  2. The terms of paragraph 24to 26 above shall apply to the Limited Edition as well as all other parts of your entry in the Competition. You agree that the Limited Edition may be used by the Promoter for sales or marketing purposes at the Promoter’s discretion.

  3. You agree that you will not receive any consideration, royalty or share of any profit resulting in the sale of the Limited Edition by the Promoter.

  4. The Grand Prize Winner must pay the cost of transport to and from his/her originating airport, travel insurance, any other travel related costs not specified above (including without limitation excess baggage charges, obtaining passports and visas to enter the UK), and for any other costs or expenses not specified above. Note that any room service, mini-bar or other charges at the hotels will be at the expense of the competitor.

  5. Travel dates are not changeable and non-transferrable. Airline tickets are economy class, non-refundable, non-transferable, and are not valid for upgrades. All reservations and travel arrangements shall be with suppliers selected by the Promoter in its sole and absolute discretion. The Grand Prize may not be combined with any other offer and travel may not qualify for frequent flyer miles. The Grand Prize is not assignable, substitutable or transferable by the Grand Prize Winner. The Promoter reserves the right to substitute a prize of equal or greater value due to unavailability of Grand Prize elements or otherwise in its absolute discretion.

  6. The approximate retail value of the Grand Prize is one thousand five hundred pounds (£1,500). The retail value of the Grand Prize will depend on the home country of the Grand Prize Winner, airfares, accommodation and other costs at the time of booking, but if the actual retail value is less than stated approximate retail value, the difference will not be awarded.

  7. If you win the Grand Prize you are responsible for assessing the tax implications of the prize and paying any tax due or owing on the prize received.

  8. A cash alternative is not available for the Grand Prize or any part of it.

  9. Details of the Grand Prize Winner will be available on the Competition website for a period of three months after the Grand Final closing date.

Advertising

  1. As a Global Competition finalist, you may be required to co-operate with Beefeater, the Promoter and its or their agency in the production of pre-event and post-event above-the-line advertising, PR and promotional materials, products, product packaging or promotional material in respect of the Competition which could include photographs and film and the publication of the recipe and name for your cocktail, packaging for products or any promotional material (“Advertising”). By entering the Competition you agree to being included in Advertising.

  2. The Promoter shall own all right, title and interest in and to any Advertising. In respect of your image rights and any materials (including the entry photograph of your cocktail), you grant Beefeater and the Promoter the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such image rights and material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You also irrevocably waive any “moral rights” you have in the Advertising and materials in favour of Beefeater and the Promoter.

Compliance with Pernod-Ricard Code for Commercial Communications

  1. During your time whist entering the Competition, travelling as part of a prize or at any time you are likely to be perceived as an ambassador of our business and brands, you agree to comply with the Pernod Ricard Code of Ethics including but not limited obligations that you will not:

    1. participate or encourage underage purchase or drinking of alcoholic beverages;

    2. participate or encourage irresponsible or immoderate drinking;

    3. participate or encourage over-consumption;

    4. encourage the drinking of alcohol during pregnancy;

    5. condemn or criticise in any way anyone who chooses not to consume alcohol;

    6. participate in any activity which portrays irresponsible drinking in a positive light or participate or encourage drinking with driving, operating any kind of machinery or engaging in any kind of dangerous activity;

    7. participate in any activity which suggests alcoholic beverages consumption contributes to any kind of success (for instance in the field of personal relationships, social success, popularity, work, sports or suggest that it can enhance mental or physical performance);

    8. participate in any activity which glorifies the alcohol strength, relatively high alcohol content or intoxicating effect of a cocktail;

    9. participate in any activity which relates drinking alcohol to any kind of illegal, antisocial, dangerous, aggressive or violent behaviour;

    10. do or fail to do anything which may bring Pernod-Ricard’s business or brands into disrepute.

    If at any time during the Competition (including, in relation to the Grand Prize Winner, for a period of one year after their selection as such ) you are considered to be practising or promoting any form of irresponsible drinking or any behaviour that will or may bring Promoter into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Competition or the security and integrity of the Competition, as assessed by the Promoter in its sole discretion, you may be disqualified from the Competition.

  2. The Global Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have the exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Global Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).
